Please read these Terms of Service ("Terms") carefully before using the Simple Life Check mobile application (the "App") operated by Worldwide Designs ("we", "us", or "our"). By downloading, installing, or using the App, you agree to be bound by these Terms.
Simple Life Check is a personal wellness check-in application. At times you choose, the App initiates a phone call to your registered phone number. If you answer, the check-in is complete. If you do not answer after three attempts, an SMS alert is sent to your designated emergency contacts.
You must be at least 18 years of age to use the App. By using the App you represent that you meet this requirement.

The App is not a medical device, emergency response system, or substitute for 911 or any other professional emergency service.
The App is a convenience tool that attempts to notify your chosen contacts. It does not contact emergency services on your behalf unless you have explicitly added an emergency service number to your contact list. You should always call 911 or your local emergency number directly when facing an immediate threat to life or safety.
We strive to keep the App and its supporting server operational at all times, but we do not guarantee uninterrupted or error-free service. Voice calls and SMS messages depend on third-party telecommunications networks (including Twilio and your mobile carrier) that are outside our control. Factors such as network outages, carrier restrictions, phone settings (e.g., Do Not Disturb mode), and voicemail configuration may prevent calls or messages from being delivered.
The App uses Twilio to place voice calls and send SMS messages, Apple Push Notification service (APNs) to deliver notifications, and DigitalOcean to host the server. Your use of the App is also subject to the terms and policies of these providers. We are not responsible for the actions or failures of third-party services.
All content, design, and code in the App are the property of Worldwide Designs and are protected by applicable intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the App without our prior written consent.
The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App will meet your requirements, operate without interruption, or be free of errors.
To the maximum extent permitted by law, Worldwide Designs and its officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of data, use, or profits, arising out of or related to your use of the App, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of these Terms or your use of the App shall not exceed the amount you paid us, if any, in the twelve (12) months preceding the claim.
You agree to indemnify and hold harmless Worldwide Designs from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the App or violation of these Terms.
You may stop using the App at any time by cancelling your schedule and deleting the App from your device. We reserve the right to suspend or terminate access to the App at our discretion if we believe you are violating these Terms.
We may update these Terms from time to time. Changes will be reflected by an updated "Effective Date" at the top of this page. Continued use of the App after changes constitutes acceptance of the revised Terms.
These Terms shall be governed by and construed in accordance with the laws of the State of Oregon, without regard to its conflict-of-law provisions. Any disputes arising under these Terms shall be resolved in the state or federal courts located in Josephine County, Oregon.
